1. General Provisions
1.1 Scope
These membership terms and conditions apply to all members of Viborg Fitness Gym (hereinafter referred to as “the Gym”) and govern the relationship between the Gym and the member.

1.3 Membership
By entering into a membership agreement, the member fully accepts these terms and conditions. Membership grants access to the Gym’s facilities during opening hours according to the selected membership type.
1.4 Age Requirements
Members under the age of 15 must have written consent from a parent or legal guardian. Members between 15 and 18 years of age must have a parent or guardian’s signature on the membership agreement.
2. Payment and Prices
2.1 Payment Terms
- Membership fees are paid monthly in advance via PBS/Betalingsservice or another agreed payment method.
- The first month’s fee and any applicable registration fee are paid upon registration.
- The membership fee is debited on the 1st of each month.
2.2 Late Payment and Fees
- In case of non-payment, access to the Gym will be suspended until payment is received.
- A reminder fee of DKK 100 will be charged for late payment.
- Fee for a replacement access chip in case of loss: DKK 50.
- Trial training for guests: DKK 50.
- Fee for unauthorized access by third parties: DKK 50.
- Continued non-payment may result in the claim being transferred to a debt collection agency at the member’s expense.
- The Gym reserves the right to terminate the membership in case of repeated late payments.
2.3 Price Changes
The Gym may change prices with at least one month’s written notice. In the event of a price increase, the member has the right to terminate the membership with immediate effect before the new price takes effect.
3. Termination and Cancellation
3.1 Member’s Termination
- Membership may be terminated with one month’s notice to the end of a month.
- Termination must be made in writing (email is accepted) and must include the member’s full name, address, and date of birth.
- Upon termination during the notice period, the membership fee for the remaining period must be paid.
3.2 Gym’s Termination
The Gym may terminate the membership:
- With one month’s notice without stating a reason.
- With immediate effect in case of gross breach of these terms.
- In case of repeated violations of rules or disruptive behavior.
3.3 Right of Withdrawal and Refunds
For distance sales (telephone/internet), the statutory right of withdrawal applies for 14 days from the date of agreement.
If you have used your membership within the 14-day period, the right of withdrawal does not apply.
3.4 Compensation for Service Interruptions
- In the event of a closure of the Gym lasting more than 14 days beyond the member’s control, a proportional refund will be provided.
- For planned renovations/maintenance, at least 2 weeks’ notice will be given.
- The member is not entitled to compensation for minor technical issues or minor repairs.
- In the event of permanent closure, unused membership fees will be refunded proportionally.
4. Use of Facilities
4.1 Access
- Upon registration, a personal access chip is issued to the member.
- The access chip is personal and may not be lent to others.
- The member is responsible for any misuse of their access.
- In case of loss of the access chip, a new chip must be ordered for a fee of DKK 50.
- If the member allows others to enter without prior agreement, a fee of DKK 50 will be charged.
- Repeated violations of access rules may result in expulsion.
4.2 Trial Training
- Members may bring a friend for trial training for a fee of DKK 50.
- Trial training must be reported to staff upon arrival and paid for on the same day.
- Trial training is only for individuals considering membership.
- The same person may only participate in trial training once.
4.3 Opening Hours
The Gym’s opening hours are stated on the website and posted in the Gym. Changes will be announced with at least one week’s notice.
4.4 House Rules
- Members must follow staff instructions.
- Smoking is prohibited throughout the Gym.
- Alcohol and drugs are prohibited.
- Members must wear appropriate workout clothing and indoor shoes.
- Photography and video recording are strictly prohibited without written consent from all individuals appearing in the recording.
- Violation of the photo/video ban will result in immediate expulsion and police notification.
- Members must clean up after themselves and follow hygiene rules.
4.5 Children
Children under 15 years may only be present in the Gym under adult supervision. The Gym may refuse children if deemed inappropriate.
5. Liability and Safety
5.1 Member’s Responsibility
- Training is at the member’s own risk.
- The member declares to be healthy and able to train.
- The member must follow safety precautions and instructions.
- The Gym recommends a medical examination before starting training.
5.2 Gym’s Responsibility
- The Gym is not liable for personal injury or property damage unless caused by intent or gross negligence on the part of the Gym.
- The Gym is not liable for theft of members’ belongings.
- The Gym recommends that members insure their own belongings.
5.3 Insurance
Members are encouraged to ensure that their own accident and liability insurance covers training activities.
6. Personal Data and Privacy Policy
6.1 Data Processing
The Gym processes personal data in accordance with the General Data Protection Regulation (GDPR).
6.2 Purpose
Data is used for:
- Administration of membership
- Payment processing
- Communication regarding membership
- Statutory retention
6.3 Member’s Rights
Members have the right to access, rectify, delete, and transfer their own data, as well as the right to withdraw consent.
7. Force Majeure
The Gym is not liable for delays or failure to fulfill obligations due to force majeure, including natural disasters, war, terrorism, government orders, pandemics, or other extraordinary circumstances beyond the Gym’s control.
8. Complaints and Disputes
8.1 Complaint Procedure
- Complaints must first be submitted in writing to Viborg Fitness Gym by phone at +45 20 98 55 76 or by email.
- The Gym will respond to complaints within 14 days.
- If the response is unsatisfactory, the complaint may be submitted to the relevant authorities.
8.2 Complaint Authorities
If a satisfactory solution is not reached, complaints may be submitted to:
- Danish Competition and Consumer Authority (for consumer complaints)
- Center for Complaint Resolution (alternative dispute resolution)
- The ordinary courts
8.3 EU Online Dispute Resolution Platform
EU citizens may use the European Commission’s online dispute resolution platform: http://ec.europa.eu/odr
8.4 Governing Law
Danish law applies to the membership.
9. Amendments
The Gym may amend these terms and conditions with one month’s written notice. Significant changes to the member’s disadvantage entitle the member to terminate the membership with immediate effect.
10. Commencement
These terms and conditions take effect on 14/07/2025 and apply to all new members. Existing members will be notified of changes with one month’s notice.
